Overview

The Florida Probate & Family Law Firm is seeking an experienced Florida-licensed Probate Attorney to join our growing legal team. This role is ideal for an attorney with strong experience in probate administration, estate planning, and contested probate matters who is comfortable independently managing cases while providing responsive, high-quality representation to clients.

The Probate Attorney will handle matters from initial consultation through resolution, working closely with clients, attorneys, paralegals, and support staff. The ideal candidate is a strong legal writer and advocate who is highly organized, detail-oriented, and confident managing deadlines, court requirements, and client expectations in a fast-paced law firm environment.

Key Responsibilities

  • Handle all aspects of probate matters, including preparing and filing petitions, drafting court documents, and overseeing estate administration.
  • Advise clients regarding estate planning matters, including wills, trusts, powers of attorney, and related documents.
  • Conduct legal research using platforms such as LexisNexis and Westlaw to support case strategy and ensure compliance with Florida law.
  • Draft clear, accurate, and persuasive legal documents, including pleadings, motions, petitions, settlement agreements, and client correspondence.
  • Manage contested probate matters and assist in resolving disputes involving estates, beneficiaries, fiduciaries, and creditor claims.
  • Develop case strategies and identify practical solutions to complex probate and estate matters.
  • Negotiate settlements and work toward efficient and favorable resolutions when appropriate.
  • Represent clients in court hearings, mediations, and other legal proceedings.
  • Maintain consistent and professional communication with clients regarding case status, deadlines, expectations, and next steps.
  • Independently manage assigned matters, deadlines, court requirements, and competing priorities.
  • Collaborate with attorneys, paralegals, and support staff to ensure matters are handled efficiently and clients receive high-quality legal representation.
  • Maintain accurate and timely case information within the firm's case-management system.

Qualifications & Experience

  • Active license to practice law in the State of Florida and in good standing.
  • 3–5 years of experience practicing probate law , with a strong background in estate administration and estate planning.
  • Experience handling probate litigation, contested estates, or other complex probate matters.
  • Demonstrated ability to independently manage probate matters and court deadlines.
  • Strong legal research and writing skills, including experience using Westlaw and/or LexisNexis.
  • Excellent drafting skills with exceptional attention to detail and accuracy.
  • Strong negotiation, advocacy, communication, and client-service skills.
  • Ability to manage multiple matters, deadlines, and priorities in a fast-paced legal environment.
  • Strong judgment, professionalism, organization, and follow-through.
  • Prior experience working in a law firm environment and using legal case-management systems is preferred.
