Construction Litigation Attorney
We are seeking a Construction Litigation Attorney to join our firm’s litigation team. The ideal candidate will manage complex construction-related disputes from intake through trial and appeal, with a focus on construction defect, casualty, and general commercial litigation. This role requires courtroom experience, strong client advocacy, and the ability to develop and implement effective case strategies to achieve favorable outcomes for owners, contractors, developers, and insurers.
Key Responsibilities
- Manage a caseload of construction and casualty litigation matters, including construction defect, breach of contract, design and professional liability, delay and disruption claims, and insurance coverage disputes.
- Handle all phases of litigation: client intake, investigation, pleadings, discovery, motion practice, settlement negotiations, mediation, arbitration, trial preparation, and appeals.
- Draft and respond to complaints, answers, motions, briefs, discovery requests, expert reports, and settlement agreements with precision and timeliness.
- Coordinate and supervise expert witnesses, including vetting experts, preparing expert reports, and conducting expert depositions.
- Work closely with clients to develop case strategy, provide regular updates, and advise on risk assessment, exposure, and settlement options.
- Represent clients at mediations, arbitrations, hearings, and trials; deliver persuasive oral arguments and examination of witnesses.
- Collaborate with in-house counsel, outside counsel, claims teams, and construction professionals to gather facts, evaluate technical issues, and develop defensible positions.
- Manage case budgets and billing, maintain accurate time and case management records, and contribute to business development and client retention efforts.
- Stay current on construction law, industry trends, building codes, and relevant regulations and case law to provide informed legal counsel.
Qualifications
- Juris Doctor (J.D.) from an accredited law school and admission to the state bar in the jurisdiction of practice.
- Minimum of 2 years of litigation experience, with a substantial portion devoted to construction litigation and construction defect matters; candidates with broader casualty or insurance litigation experience will also be considered.
- Proven courtroom experience including depositions, motion practice, and trials; arbitration and mediation experience preferred.
- Strong knowledge of construction contracts, project delivery methods, building codes, defect investigation processes, and insurance coverage issues.
- Demonstrated ability to manage complex technical cases, work with expert witnesses, and communicate effectively with clients, contractors, engineers, and architects.
- Excellent legal writing, analytical, and oral advocacy skills; attention to detail and ability to meet deadlines under pressure.
- Ability to develop case strategy, assess exposure, and negotiate settlements to achieve client objectives.
- Strong interpersonal skills, collaborative mindset, and business development aptitude.
