Litigation AttorneyA growing and entrepreneurial law firm is seeking an experienced Litigation Attorney to join its expanding Trusts & Estates Litigation Practice in New York. This is an excellent opportunity for an attorney who enjoys handling sophisticated, high-stakes disputes while working closely with clients through complex and often sensitive personal and family matters.The ideal candidate will have a minimum of five years of litigation experience and a strong foundation in one or more of the following areas: trusts and estates, fiduciary litigation, guardianship proceedings, Surrogate's Court practice, elder law, or matters involving issues of capacity and undue influence.This position offers substantial client contact, meaningful courtroom experience, and the opportunity to work on challenging matters alongside experienced practitioners in a collaborative and supportive environment.Position OverviewThe attorney will manage a diverse caseload involving contested estate and trust matters, fiduciary disputes, guardianship proceedings, and related litigation in New York Surrogate's Court, Supreme Court, and federal courts. The successful candidate will be comfortable taking ownership of matters, developing litigation strategy, and guiding clients through emotionally charged and financially significant disputes.Key ResponsibilitiesHandle all phases of trusts and estates litigation matters from inception through resolutionRepresent clients in Surrogate's Court, Supreme Court, and federal court proceedingsDraft and argue motions, pleadings, discovery requests, and other litigation-related documentsConduct depositions, witness examinations, and fact investigationsAppear at court conferences, hearings, mediations, and trialsAdvise fiduciaries, beneficiaries, executors, trustees, and family members regarding contested estate and trust mattersHandle disputes involving: Will contestsTrust contestsFiduciary misconduct claimsAccounting proceedingsGuardianship mattersCapacity and undue influence claimsEstate administration disputesCollaborate with attorneys across practice groups to develop effective client solutionsMaintain strong client relationships through clear communication and strategic counselQualificationsJuris Doctor (J.D.) from an accredited law schoolAdmission to the New York Bar requiredMinimum of five years of litigation experienceExperience in one or more of the following: Trusts and estates litigationFiduciary litigationSurrogate's Court practiceGuardianship proceedingsElder law mattersCapacity and undue influence disputesStrong legal research, writing, and analytical skillsExperience drafting substantive motions and litigation documentsDeposition and courtroom experience preferredAbility to manage multiple matters independently while maintaining exceptional attention to detailStrong interpersonal skills and the ability to counsel clients through sensitive and emotionally complex situationsAbout the PracticeSophisticated and intellectually engaging litigation mattersA collaborative and collegial work environmentConsistent pipeline of high-quality workSignificant client interaction and courtroom exposureMentorship and professional development opportunitiesBusiness development support and resources designed to foster long-term practice growthA platform that encourages entrepreneurial attorneys to build and expand their practicesCompensation & BenefitsCompetitive compensation, commensurate with experiencePerformance-based bonus opportunitiesComprehensive benefits packageLong-term career advancement opportunitiesWork ArrangementThis position will begin as a fully in-office role to facilitate integration, training, and collaboration.
