- Provide strategic legal and regulatory advice on derivatives, structured products, and trading-related matters
- Partner with trading, sales, risk, compliance, and operations teams to support business objectives and manage legal and regulatory risk
- Draft and negotiate ISDA Master Agreements, CSAs, Control Agreements, Risk Participation Agreements, and related trading documentation
- Recommend and implement solutions based on analysis of issues and business implications
- Identify emerging issues and trends to inform decision-making
- Exercise judgment on moderate to complex decisions within policies and regulatory requirements
- Deliver legal advice and instruct external counsel
- Ensure compliance with internal policies and procedures
- Act as a subject matter expert on relevant laws, regulations, and policies
- Resolve daily issues or elevate them with analysis and recommendations
- Identify risks and implement mitigation actions
- Implement improvements for consistency with marketplace practices
- Build effective internal and external stakeholder relationships
- Provide specialized consulting, analytical, and technical support
- Participate in project-related matters within the Derivatives Legal Group and Capital Markets Legal Team
- Handle non-routine situations independently and perform other assigned accountabilities
Requirements
- Less than 7 years of legal practice or an equivalent combination of education and experience
- Degree in law (LLB or JD)
- License to practice law in relevant jurisdiction
- Private practice, in-house experience, or experience at a regulatory body relating to regulation of business/group activities may be required
- Experience drafting and negotiating derivatives documentation, including ISDA’s, CSA’s, Control Agreements, Confidentiality Agreements, Risk Participation Agreements, Master Confirmation Agreements, Long-Form Confirmations, and ancillary derivatives documentation
- Knowledge of legal requirements and the business and regulatory environment in which BMO Financial Group operates
- Proficient knowledge of subject matter legal requirements and operations of a single client group
