To provide legal services for Mille Lacs County by prosecuting criminal cases and providing legal representation in civil lawsuits to protect the health, safety and welfare of the citizens of Mille Lacs County.

This position will involve criminal and/or civil duties of the County Attorney's Office, depending on experience and qualifications. Interest or experience in civil law is preferred but not required. This posting is being posted in conjunction with job posting 00900-Assistant County Attorney I; only one of these two positions will be filled.


Essential Functions


This job description indicates the normal type and level of work expected of the incumbent. Incumbent may be asked to perform other duties as apparent or assigned.



  • Consults and advises law enforcement officers and other enforcement agencies preparatory to issuing criminal complaints.

  • Makes decisions regarding the filing of criminal charges and to what extent on misdemeanor, gross misdemeanor and limited felony matters with supervision of the County Attorney.

  • Determines which evidence and witnesses to use in a trial; judges appropriateness of plea agreements, whether or not to dismiss charges, and determines appropriateness of sentences on misdemeanor, gross misdemeanor and limited felony matters with supervision of the County Attorney.

  • Drafts complaints for criminal prosecutions and prepares and conducts prosecutions of defendants in criminal actions in district and municipal courts on misdemeanor, gross misdemeanor and limited felony matters with supervision of County Attorney.

  • Represents the County at preliminary hearings and arraigning of defendants.

  • Consults with and advises the county board, county officials, employees, representatives, commissions and boards regarding their respective powers, duties, and obligations.

  • Discusses possible plea agreements with opposing counsel and attends pretrial and evidentiary hearings.

  • Receives juvenile reports and prepares delinquency, dependency, neglect and/or termination of parental rights petitions through each petition's final adjudication.

  • Consults and advises police officers and other law enforcement personnel on law enforcement office policy and procedure.

  • Informs witnesses about court procedures and reviews all testimony before trial.

  • Consults and advises county agency clients and county support and collection personnel regarding paternity, child support, welfare and URESA matters.

  • Consults, advises, and represents the County in welfare appeal and inebriety/mental illness commitments.

  • Drafts warrants and information, prepares search warrants, directs investigations, witness interviews, conducts legal research, prepares memoranda of law and briefs supporting trial tactics, motions, jury instructions, and drafts pleadings and proposed findings, orders and judgments.


Minimum Qualifications



  • Juris Doctorate Degree from an accredited law school.

  • Admission to the Minnesota State Bar (valid license to practice law in the State of Minnesota).

  • Class D Driver's License.

  • Experience practicing criminal law (or civil governmental law when applicable), including litigation of proceedings regarding state, county, and city matters is preferred.

Employees may choose to contribute additional funds to their HSA each year, up to the IRS limit of $4,400 for singles, and $8,750 for families. Once at age 55, employees can contribute an additional $1,000 (to either single or family) as long as they are not covered under Medicare. The IRS limit applies to the total employer and employee contributions combined. Employer contributions (if eligible) will go into a Health Savings Account.


Dental Insurance


There is no cost to the employee for single coverage. Family coverage costs the employee $76.46 per month.


Vision Insurance


Vision coverage is available and paid for by the employee at the following monthly rates:



  • Employee Only - $5.85

  • Employee + Spouse - $11.69

  • Employee + Children - $11.31

  • Family - $18.35


Flexible Spending Accounts (FSA's) Available


Plan options include medical and dependent care FSAs, as well as a premium only plan (pre-tax deduction of medical and dental premiums). These amounts cannot be changed during the year unless there is a qualifying life event. All funds must be used by the claims deadline.



  • FSA Medical/Health max election of $3,400 per year

  • Limited Purpose FSA max election of $3,400 per year (funds can only be used for vision, dental or orthodontia expenses when paired with an HSA until medical deductible has been met)

  • FSA Dependent Care max election of $7,500 per year per family ($3,750 if married and filing separately)


Paid Time Off


Holidays: Full-time employees have approximately 14.5 paid holidays per year, including floating holidays, subject to the terms of the Personnel Policy or Collective Bargaining Agreement as applicable.


Vacation: Full-time employees earn 11 to 23 days per year, depending on tenure. Part-time employees earn pro- rated accruals.


Sick Time: Full-time employees accrue 12 sick days per year. Part-Time employees earn pro-rated accruals.
